This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16). The arbitration will be before a single arbitrator under the American Arbitration Association Consumer Arbitration Rules (available at adr.org/rules), and the arbitrator’s decision will be final and binding on both parties. This agreement does not apply to Disputes within the jurisdiction of small claims court.
Class Action Waiver: Any Dispute will be handled individually. You may not join with other people who have a similar problem to bring a single case, and you may not participate in a class action lawsuit or class action arbitration against us.
In the event of a conflict between this arbitration agreement and any other arbitration agreement between you and us (such as one contained in a retail installment sale contract, purchase order, or lease agreement), the terms of that other agreement shall govern.
Venue & Choice of Law
This Privacy Policy has been made in, and shall be construed in accordance with, the laws of the State of Tennessee without giving effect to any conflict of law principles.
